GENERAL TERMS:

BY RECIVING JOBS VIA OUR WEBSITE, YOU (“DRIVER/CHAUFFEUR/SUBCONTRACTOR”) AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS (“TERMS”). THESE TERMS ALSO APPLY TO THE SUPPLY OF ALL TRANSPORTATION SERVICES AND OTHER SERVICES BOOKED VIA THE WEBSITE (WWW.EXCELCHAUFFEURS.COM), TELEPHONE, EMAIL, SMS OR APP.

 

*** Please read and understand these terms and conditions carefully before providing your services via Excel Chauffeurs ***

 

1. SAFETY IS ALWAYS OUR NUMBER ONE PRIORITY:

1.1. Under no circumstances should you drive in an unfit condition, under the influence of alcohol, or any other drugs.

1.2. Under no circumstances should you speed or drive in a dangerous manner.

 

2. PROFESSIONALISM:

2.1. Personal service, attention to detail, and the comfort and safety of our clients are our hallmarks.

2.2. Chauffeurs must strive for ultimate professionalism as the first point of contact with our clients.

 

3. DRIVER REQUIREMENTS:

3.1. You must have a valid driving license and PCO driver’s license, along with all necessary documents required by the PCO.

 

4. DRESS CODE:

4.1. Chauffeurs must maintain a smart appearance, wearing a dark suit, shirt, tie, and polished dark shoes.

 

5. VEHICLE REQUIREMENTS:

5.1. Vehicles must have a valid PCO license and undergo a 6-monthly MOT (if required).

5.2. The vehicle should be in good roadworthy condition and cleaned before each day’s work and between jobs when necessary.

5.3. Chauffeurs should ensure the presence of water (Evian or over brand), newspaper (if required), tissues, mints, umbrella, and Wi-Fi / Personal Hotspot in the vehicle.

5.4. Any damage to the vehicle should be reported before undertaking any job.

5.5. Vehicles accepted must be a minimum of 3 years old from the first registration.

 

6. DEALING WITH CUSTOMERS:

6.1. Chauffeurs must be courteous and polite, accommodating the customer’s desire for conversation or privacy.

6.2. Always open doors for clients and offer assistance with luggage.

6.3. Inform clients about the available amenities in the vehicle, such as water, newspapers, and Wi-Fi.

6.4. Always advise the client about the destination and any changes requested by the client must be authorized by the office beforehand.

6.5. Adhere strictly to a confidentiality agreement, maintaining the privacy of clients.

 

7. DRIVING STANDARDS:

7.1. Chauffeurs must drive at safe and sensible speeds in accordance with road conditions, traffic, and legal speed limits.

 

8. DOCUMENTS:

8.1. Chauffeurs must furnish Excel Chauffeurs with all personal and vehicle documents in accordance with PCO requirements.

8.2. Excel Chauffeurs cannot offer any work to subcontractors if we do not have all these documents.

8.3. It is the responsibility of chauffeurs to keep these documents up to date.

 

9. AIRPORT PICKUPS AND DROP-OFFS:

9.1. Chauffeurs should monitor flight numbers and arrive as instructed on the booking form.

9.2. Waiting time is charged in 15-minute segments starting one hour after the designated pickup time.

9.3. Chauffeurs must wait at arrivals with an Excel Chauffeurs name-board, ideally on an iPad or similar, clearly displaying the client’s name and our brand.

9.4. Always offer assistance with luggage.

 

10. WEDDINGS:

10.1. Chauffeurs should have ribbons on the vehicle for weddings (if required). You will be refunded for that.

10.2. Contact the client before the wedding to familiarize yourself with the details and arrive at least 15 minutes before the pickup time.

10.3. Punctuality is crucial for wedding jobs; failure to meet expectations may result in non-payment.

10.4. If you are late for a wedding and the customer requires a refund, or your duties were not carried out properly for their big day, you will not be paid for that job.*

10.5. Although we do not have an alcohol license clients may bring champagne with them. Please ensure they use plastic champagne flutes for safety reasons.

 

11. PAYMENT:

11.1. Excel Chauffeurs pay on a weekly (every Wednesday but not late than Friday in case of bank holiday) basis however this is paid after receipt of your invoice. The week is based from Monday to Sunday. Please note that in rare instances, payment may be delayed but will not be later than Friday, same week.

11.2. The week after you have completed your jobs, you will be sent your invoice until Wednesday. If the invoice has not been received, the payment will be postponed until next Wednesday.

11.3. Excel Chauffeurs receive 40% of the booking price, and the subcontractor receives the remaining 60%. In some cases, this does can vary, but before you accept a booking from us you will be told what the job is worth to you.

11.4. Self-employed chauffeurs will receive a driver statement before payment.

 

12. TIMEKEEPING AND PUNCTUALITY:

12.1. Company policy requires chauffeurs to arrive 10 minutes before any pickup time.

12.2. To provide appropriate trip information to passengers, push “On Route” (in the app) ‘60 min prior to pick up time.

12.3. If you anticipate being late even for 1 minute, inform the office at least 45 minutes beforehand (time valid for trips inside M25) to warn the client or find a replacement vehicle.

12.4. If you are late for a pickup and the customer requests a refund, or if the car and driver need to be replaced due to your lateness, you will not be paid for that job.* 

 

13. BOOKINGS:

13.1. Excel Chauffeurs staff will email, text or call you to see if you are available for a job.

13.2. Excel Chauffeurs controllers will email you that job.

13.3. Chauffeur should email back or accept it in the app to confirm he has received that job.

13.4. After the job, chauffeur to email operator, text or add in the app, with any additional extras such as parking or waiting, along with any notes from that job.

13.5. Excel Chauffeurs must receive any extras no later than 12 hours after the job is completed by email.

13.6. Please be accurate with waiting time.

13.7. Bookings must be taken through the office, so if a customer wishes to book another journey, please give them the office details.

13.8. Chauffeurs are responsible for checking addresses and flight numbers and preparing journeys in advance.

 

14. BOOKING CANCELLATION BY CUSTOMER:

We understand that circumstances can change, and bookings may need to be cancelled. However, to ensure fairness to our dedicated drivers who have allocated their time, we have implemented the following cancellation policy.

14.1. If a job is cancelled more than 120 minutes (2 hours) before the scheduled start time, no payment will be made to the driver.

14.2. If a job is cancelled less than 120 minutes (2 hours) but more than 90 minutes (1 hour and 30 minutes) before the scheduled start time, the driver will receive 25% of the agreed payment for the job.

14.3. If a job is cancelled less than 90 minutes (1 hour and 30 minutes) but more than 60 minutes (1 hour) before the scheduled start time, the driver will receive 50% of the agreed payment for the job.

14.4. If a job is cancelled less than one hour prior to the scheduled start time, the driver will receive the full agreed payment for the job.

This cancellation policy helps to ensure our drivers are compensated for their time and commitment. It also encourages respect for their schedules and availability.

By agreeing to work with us, drivers acknowledge this cancellation policy and agree to its terms.

Please note, drivers will be notified of any cancellation as soon as possible. The payment according to this policy will be processed within a reasonable time frame.

 

15. BOOKING CANCELLATION BY THE DRIVER:

We value the commitment and service of our drivers, and we also respect the schedules and commitments of our customers. Therefore, we have set the following rules regarding booking cancellations by drivers:

15.1. Prior to accepting any booking, drivers should review the details of the job carefully alongside their own schedule. We strongly discourage last-minute cancellations. Unless a valid reason is provided, drivers are not permitted to cancel any accepted job less than 4 hours before the scheduled start time during the office hours (08:00am to 22:00) and less than 10 hours before the scheduled start time during the night (22:00 to 08:00am)

15.2. We understand that unexpected events may occur. If there are exceptional circumstances that require a driver to cancel a booking, these should be communicated to us as soon as possible (By Phone Call) so we can make alternate arrangements.

15.3. In the event that a job is canceled by the driver due to a flight delay (valid just for the airports pick up and minimum time accepted for cancellation is if the flight exceeding 90 minutes delay and must be communicated with a minimum 75 minutes in advance prior the landing time during the office hours), and the driver is unable to complete the job for personal reasons resulting from this delay, which is beyond the control of both the company and the client, the drivers will not receive any payment for that trip / booking, even if they have arrived at the pick up location. We remind our drivers that it is their responsibility to monitor flights in real time and to exhibit flexibility in cases of minor or major flight schedule changes.

15.4. Drivers are required to fulfill any bookings they have accepted. Once they have arrived at the location, drivers should not cancel a current booking if it impacts a future job reservation with another company due to extra waiting time requested by the customer or a change in his/her itinerary. Flexibility with clients’ itinerary changes and job organization on that day is expected to be the responsibility of all drivers, who should reorganize accordingly. Cancelling a trip due to client-requested modifications, such as extended wait times or itinerary changes, will result in non-payment for the trip, irrespective of the time spent at the pickup location. Furthermore, such cancellations could lead to permanent exclusion from future jobs or booking opportunities.

15.5. Repeated breaches of this cancellation rule could result in the driver being removed from our list for future jobs. This is to ensure a reliable service for our customers, and to uphold the reputation and integrity of our service.

15.6. Drivers who cancel a job less than 4 hours prior the pickup time (during the office hours 08:00am to 22:00) and less than 8 hours prior the pickup time (during the night – from 22:00 to 08:00am) before the start of a booking, excluding exceptional circumstances, may be removed from our list for future jobs. This firm rule is in place due to the significant inconvenience such short-notice cancellations cause to our customers.

 

16. LICENSING INFORMATION SHARING & COMPLIANCE RULES WITH EXCEL CHAUFFEURS:

16.1. Document Sharing Agreement: As a driver subcontracted with Excel Chauffeurs, you understand and agree that if you are a TfL (Transport for London) licensed driver, your documentation may be shared with our TfL fleet partners and operators. This is in accordance with our commitment to ensure full compliance with licensing and regulatory obligations across the different areas we operate in.

16.2. Confidentiality & Job Coverage: Any information shared with our fleet partners operators will be used solely for the purpose of verifying your eligibility to provide chauffeur services under their jurisdiction and to facilitate the coverage of assignments. It is understood that the jobs assigned to you will be carried out under their respective operating licenses.

16.3. Data Protection: We comply with all relevant data protection legislation. Personal information will be held securely and will be processed in a manner that ensures appropriate security of the personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage.

16.4. Agreement: By joining Excel Chauffeurs and providing your service, you signify your acceptance to share your licensing details with our fleet partners and operators if you are a TfL driver.

 

17. NO EMPLOYMENT:

17.1. During the term of this Agreement, it is agreed that the Driver’s status vis-a-vis the Company is that of an independent contractor (subcontractor) and not an employee of the Company.

17.2. The relationship between the driver and EXCEL CHAUFFEURS will be that of principal and agent, and nothing in this agreement shall render the driver an employee, worker, or partner of EXCEL CHAUFFEURS, nor should the driver hold themselves out as such.

17.3. This agreement constitutes an agency agreement and not a contract of employment. Accordingly, the driver shall be fully responsible for and shall indemnify EXCEL CHAUFFEURS for any tax, social security contributions, or other statutory levies or deductions that may be due in relation to any consultancy fee, commission, or expenses payable pursuant to this Agreement.

17.4. The Driver agrees that they will be responsible for the payment of any tax, social security contributions or other statutory levy.

17.5. The driver is responsible for any VAT payable to HMRC on any amounts payable under this Agreement. The driver shall communicate their VAT status to the Company and notify any changes to it on a timely basis (which shall not be later than 7 days since the date of change).

17.6. The driver agrees to fully indemnify and keep fully indemnified the Company against all and any liabilities for income tax, social security contributions, or other statutory levies, deductions, or imposts arising in respect of any fee payable under this Agreement.

 

18. DRIVERS:

18.1. Access to EXCEL CHAUFFEURS services is only permitted for registered drivers who meet the specified criteria.

18.2. All drivers must maintain a smart appearance, wearing a suit, tie, shirt, and shoes while providing services under this agreement.

18.3. Drivers are prohibited from using handheld telephones while driving and from smoking in the presence of customers.

18.4. Upon arrival at a collection point, drivers must ensure that the customer is the correct individual and should assist customers with their luggage in a polite manner.

18.5. Drivers must carry tablets (iPad or similar) when meeting customers for any journey booked by the company.

18.6. Drivers are not allowed to solicit business from any customer introduced to them by EXCEL CHAUFFEURS, and any such behaviour will be prosecuted and reported to the relevant authorities.

18.7. Drivers should be at the pickup point at least 10 minutes prior to their allotted pickup time.

 

19. DRIVER DETAILS:

19.1. The supplier (driver) must inform the company within 7 days of any changes in address, telephone, email address, bank details, or VAT status. The driver must ensure they are contactable by phone and email.

 

20. CONFIDENTIALITY:

20.1. The driver shall uphold strict confidentiality with respect to all matters pertaining to this agreement and the business of the Company. This includes, but is not limited to, customer information, journey details, financial transactions, and any other sensitive or proprietary information. The driver shall not disclose or share such information with any third party, including other operators, competitors, or any unauthorized individuals. Whatever is said and done inside and outside the vehicle is strictly confidential.

20.2. Furthermore, the driver shall not save or store any customer details, including personal information, contact information, or any other data related to the clients of Excel Chauffeurs. All customer data shall be handled in strict accordance with applicable data protection laws and regulations.

20.3. Any breach of confidentiality by the driver may result in immediate termination of this Agreement and may lead to legal action or other remedies pursued by the Company.

20.4. The driver acknowledges that maintaining the confidentiality and privacy of our customers is of utmost importance, and they shall comply with all confidentiality and data protection requirements set forth by Excel Chauffeurs.

 

21. Driver Location Sharing Agreement

21.1. By accepting assignments from us and using our provided application (where applicable), you, as the driver, consent to share your live location. This can be done either directly through our application or through alternative applications such as WhatsApp. Please note that it is your responsibility as the driver to cease sharing your location upon the completion of a job. This can be achieved by closing our application or stopping the live location feature in other applications like WhatsApp. 

 

22. INSURANCE / LICENCES:

22.1. The supplier (driver) must ensure that all vehicles allocated to transfers booked by the company have a valid Private Hire Licence and appropriate insurance (fully comprehensive). Drivers and their vehicles must always comply with all laws and regulations. The Company requires a copy of all documents, registrations, licences, policies, etc., pertaining to the driver’s compliance.

 

23. TERMS OF LIABILITY FOR DRIVERS

23.1. Please note that Excel Chauffeurs does not assume responsibility for damages caused directly by its customers. While we are committed to providing an excellent service, we cannot control the actions of our customers that result in material damage. Accordingly, Excel Chauffeurs disclaims any direct liability in the unfortunate event of material damage caused by customers.

 

24. CUSTOMER SERVICE:

24.1. The Company is committed to providing a first-class service to all its customers, and accordingly, all drivers will always employ the highest standards of service possible. The Company reserves the right to withhold payment in the case of serious complaints received from customers about a driver.

 

25. VEHICLES:

25.1. The supplier must ensure that all vehicles provided will be a maximum of five years old, be air-conditioned, and carry hands-free mobiles that the driver can use legally while the vehicle is in motion. All vehicles should be free of mechanical defects and regularly maintained, ensuring they are of the highest standard.

 

26. ENTIRE AGREEMENT:

26.1.These Terms and Conditions represent the entire understanding relating to the use of the Website and supersede all other statements, representations, or warranties (whether written, made by email, or oral) made by us.

26.2. Nothing in these Terms and Conditions shall affect the liability of either party in respect of any misrepresentation, warranty, or condition that it makes fraudulently.

 

27. TERMINATION:

27.1. The Company reserves the right to terminate this agreement at any time without any reason and immediately in the event that the Driver breaches any of these Terms and Conditions.

27.2. The Company also reserves the right to terminate this agreement immediately in the event that the Driver is found to be unfit to drive, or if any complaints received from customers about the Driver’s behaviour, or driving ability, are deemed by the Company to be of a serious nature.

Agreed costs are in place and are used to reimburse passengers for the retention vouchers we provide, and/or to adjust the price of trips (uplift)  when reallocating them to another driver.

 

29. The company reserves the right to change these terms and conditions at any time.
